General Terms and Conditions of Sale (GTCS)

Scope of Application

These General Terms and Conditions of Sale (GTCS) apply to all sales of products offered on the online store accessible via the website www.mentefit.fr (hereinafter referred to as “the Site”), operated by Margaux Cujean.

The owner of the website www.mentefit.fr reserves the right to modify these General Terms and Conditions of Sale at any time. The modifications take effect as soon as they are published on this page. Users are advised to consult this section regularly.

Products and Availability

MenteFit offers items dedicated to sport, well-being, and muscle recovery. The essential characteristics of the products are presented on their product description page.

Products are offered within the limit of available stock. In the event of unavailability after validation of the order, the Customer will be informed by email and may choose between:

  • a full refund
  • or an equivalent product if available

Photographs are provided for indicative purposes. Minor differences may exist (color, finish, etc.) without affecting the main functionalities of the product.

Prices and Taxes

European Union (EU)

Prices are indicated in euros (€), all taxes included.

No additional customs duties or taxes will be applied for deliveries within the European Union.

Deliveries outside the European Union

For any order delivered outside the European Union, customs duties, import taxes or administrative fees may be required by the authorities of the destination country.

Any additional charges remain entirely the responsibility of the customer and must be paid directly to the relevant authorities or carrier upon delivery.

The seller cannot be held responsible for any additional charges applied by local customs authorities. It is the customer’s responsibility to check with the customs services of their country before placing an order.

Orders and Payment

Payment Process

To place an order, the Customer must follow the following steps:

  • Selection of products and adding them to the cart
  • Entering delivery information
  • Choosing the payment method
  • Acceptance of these General Terms and Conditions of Sale
  • Final validation
  • Receipt of an order confirmation email

The Seller reserves the right to refuse or cancel any order for legitimate reasons (e.g.: suspicion of fraud, payment incident, previous dispute).

Payment is made online by credit card or via secure payment solutions.

Payments are charged at the time of the order.

The order will only be processed after full validation of the payment.

Delivery

Products are delivered to the address indicated at the time of the order. Products are shipped from our various logistics centers located in Europe or internationally.

Delivery times are provided for indicative purposes, and in the event of a delay exceeding thirty (30) days, the Customer may cancel the order and obtain a refund.

Delivery Areas

We currently deliver to all countries within the European Union.

Delivery Times

Delivery times are estimated between 6 and 12 business days from the dispatch of the order, depending on the destination country.

These timeframes are provided for indicative purposes and may vary depending on the destination, peak periods, customs procedures, or circumstances beyond our control.

Shipping costs vary depending on the number of items ordered and the destination country. The exact amount of shipping costs is indicated to the Customer during the order finalization stage, before payment validation.

Transport and Transfer of Risks

In accordance with applicable legislation, the risks related to transport are transferred to the Customer at the time of actual receipt of the product.

In the event of damage observed upon delivery (damaged parcel, broken or missing item), the Customer is invited to:

  • make reservations with the carrier, where possible;
  • contact our customer service at contact@mentefit.fr within an indicative period of forty-eight (48) hours after receipt, providing any useful evidence (in particular photos).

These steps are intended to facilitate the processing of the claim and do not affect the Customer’s rights under the legal warranty.

Right of Withdrawal and Returns

In order to provide a smooth and appropriate customer experience, any request for return, withdrawal, or refund must be sent to our customer service prior to any action.

No product return must be made without our prior agreement.

Any return made without express authorization shall not engage our liability. In such a case, we cannot be held responsible for the loss of the product nor proceed with a refund or an exchange.

Returns within the European Union

In accordance with Directive 2011/83/EU, Customers residing in the European Union have a right of withdrawal of 14 days from the receipt of their order.

The Customer must notify their intention to withdraw by email at contact@mentefit.fr within the specified period.

The terms of handling the request (refund, exchange, or alternative solution) are defined by our customer service after analysis of the situation. In many cases, a solution may be offered without requiring the return of the product.

Refund Terms

Once the request has been approved by our customer service, the refund is made via the payment method used at the time of the order, no later than 14 days from the notification of the withdrawal.

The processing time is generally a few business days, to which bank processing time may be added.

The precise terms are communicated to the Customer after analysis of the request by our customer service.

Legal Warranty

In accordance with applicable legislation, the products sold on our website benefit from the legal warranty against defects of conformity or malfunction, in accordance with the conditions provided by the law of the Customer’s country of residence.

In the event of a defect covered by the legal warranty, the Customer may request an appropriate solution, such as repair, replacement, price reduction, or refund, in accordance with the applicable regulations.

Certain products may also benefit from a commercial or manufacturer’s warranty, the duration and conditions of which are specified on the relevant product page.

This commercial warranty applies without prejudice to the legal warranty.

Exclusion of Warranty

The following are not covered:

  • normal wear and tear of the product
  • improper use, negligence, or accident
  • products modified, disassembled, or repaired without our prior agreement
  • damage resulting from failure to follow instructions for use, maintenance, or safety

Protection of Personal Data

We comply with Swiss legislation (LPD) as well as the General Data Protection Regulation (GDPR) for Customers located in the EU.

The data collected is used only for:

  • order processing
  • communications related to customer service
  • with the Customer’s consent, internal marketing operations

A response will be provided within a reasonable period.

In the event of a persistent disagreement, the Customer may also refer the matter to the competent data protection authority in their country of residence.

Liability

The Seller undertakes to provide products that conform to the order placed by the Customer and in compliance with the applicable regulations. However, the Seller’s liability cannot be engaged in the following cases:

  • improper use or use not in accordance with the products by the Customer
  • delivery delays due to carriers, postal services, or customs authorities, beyond our control
  • temporary unavailability of the website due to maintenance or technical malfunction beyond our control

When the Seller’s liability is engaged, it is limited, within the limits provided by law, to the amount of the order concerned.

Retention of Ownership

The transfer of ownership of the products to the Customer takes place only after full payment of the price.

Until delivery, the products remain under the responsibility of the Seller or its logistics partners.

From the time of delivery, the responsibility is transferred to the Customer.

Customer Reviews

The reviews published on the Site come from customers who have made a purchase. The Seller verifies their authenticity before publication and reserves the right not to publish reviews that are non-compliant or abusive.

Customer Accounts

The Customer is solely responsible for the confidentiality of their login credentials and for the use of their account. Any order placed via a customer account is deemed to have been made by the Customer.

Promotional Codes

Promotional codes are valid under the conditions specified at the time of their issuance. They are neither cumulative nor refundable and may be deactivated at any time without prior notice.

Applicable Law and Jurisdiction

These General Terms and Conditions of Sale are governed by Swiss law.

In the event of a dispute, the parties will endeavor to find an amicable solution. Failing this, only the courts of the canton of Geneva shall have jurisdiction.

For consumer customers residing outside Switzerland, the more protective mandatory provisions provided by the law of their country of residence may apply, in accordance with applicable international rules.
